1. Introduction

Welcome to Advetter, your ARCON Vetting Assistant, a service provided by Intense Digital ("we," "us," or "our"). By accessing or using our website and services at arcon-vetting.intense.ng (the "Service"), you agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully before using the Service. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Advetter is a tool designed to help users prepare advertising creatives and supporting documentation for submission to the Advertising Regulatory Council of Nigeria (ARCON). Our Service provides:

• Analysis of advertising creatives against compliance guidelines
• Generation of compliance checklists and recommendations
• Organization and management of supporting documents
• Export of vetting pack documentation

Important: Our Service is a preparatory tool only. We do not guarantee ARCON approval, nor do we submit materials directly to ARCON on your behalf. Final approval decisions rest solely with ARCON.

3. User Accounts

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. User Content

You retain ownership of all content you upload to the Service ("User Content"), including advertising creatives, documents, and other materials. By uploading User Content, you grant us a limited license to:

• Store and process your content to provide the Service
• Display your content back to you within the Service
• Create backups for data protection purposes

You represent and warrant that you have all necessary rights and permissions to upload and use the User Content, and that your content does not infringe on any third-party rights.

5. Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, or violates any laws
• Infringe on intellectual property rights of others
• Upload malicious software, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use the Service for any fraudulent or deceptive purposes
• Resell or redistribute the Service without authorization

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Intense Digital and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy of compliance analysis
• Warranties that use of the Service will result in ARCON approval

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTENSE DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

9. Indemnification

You agree to indemnify, defend, and hold harmless Intense Digital and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including but not limited to:

• Breach of these Terms
• Conduct that we believe is harmful to other users or the Service
• Request by law enforcement or government agencies

You may also terminate your account at any time by contacting us or using the account deletion feature in your dashboard.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the changes becoming effective. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Nigeria.
